1. Acceptance of the General Conditions of Sale and conclusion of the contract

1.1 The contract between FiloBlu Spa (hereinafter referred to as "FiloBlu") and the Client (that is the party or individual who makes the purchase on the Website, but not a commercial, business, or professional activity) will be finalized with the acceptance of the order by FiloBlu. If the order will not be accepted, FiloBlu will promptly notify the Client.  

1.2 By placing an order through one of the available methods, according to the order form on the Website (hereinafter referred to as the "Order"), the Client confirms having read all the information provided during the purchase process and confirms full acceptance of these General Conditions (hereinafter referred to as the "Conditions").

1.3 These Conditions may be printed or saved on a durable medium, in accordance with the provisions of Article 12 of Italian Legislative Decree 70/2003 and Article 51 of Italian Legislative Decree 206/2005, as amended by Italian Legislative Decree 21/2014.


2. Purchase process

2.1 The only products on sale managed by FiloBlu are those on the website when placing the Order, as described on the information pages.   

2.2 However, the images and the information regarding a product are shown for information purposes only and may not be wholly representative of the product's features, as they may differ, for example, in color and size (in some cases due to the browser and screen used to access the Website and view the images).

2.3 To place an Order, the Client must complete the process on the Website and send it after carefully reading the Conditions as well as the features of the product and/or products that the client intends to buy. The Client can also ask FiloBlu, if desired, to send a tax invoice for the purchase, according to Article 22 of Italian Presidential Decree no. 633/1972.

2.4 After the order is placed a confirmation will arrive from FiloBlu with an email, sent to the email address indicated by the Client. This confirmation message includes a summary of the purchase conditions, according to applicable regulations, as well as the details provided by the Client on the Order, so that the Client may check said details and communicate any necessary correction.


 3. Prices and Payment Methods

3.1 The prices indicated on the Website are to be considers taxes and VAT included. Any aelivery costs or payment charges will be notified in advance to the Client on the Website or through the general Conditions.

3.2 The following payment methods are accepted:

(i) PayPal

Clients may pay via PayPal in accordance with the specific methods set by this platform.

(ii) Credit card

When using a credit card, the transaction may be performed via the PayPal secure server or another secure server selected by FiloBlu.

In any case FiloBlu will not be able to access the Client's credit card details, which shall be transmitted through a secure connection directly to the banking institute that manages the transaction. No electronic record of FiloBlu will archive these details and therefore under no circumstances FiloBlu will be responsible of any fraudulent and unauthorized use of the credit cards by third parties at the time of payment.

(iii) Bank Transfer (only for European Union countries)

In case of purchase with bank transfer, the website will display the details for the bank transfer. The goods will be shipped only after receiving the payment.


4. Delivery of products and related charges

4.1 The purchased products will be shipped by our warehouse within 24-48 hours. Once your products are shipped, they will be delivered within 1-6 working days to the address indicated on the Order.

The delivery costs are shown during the process and FiloBlu reserves the right to accept or refuse requests for delivery beyond the territories of Italy or Europe. In any case, for deliveries outside the territories of Italy, delivery expenses and delivery times may be subject to change.

4.2 Deliveries within European Union will not be charged with customs fees. Deliveries to the USA will be shipped with Delivery Duty Paid. In this case the, the client will not be charged with customs fees. For the rest of the world custom duties and taxes borne by the customer according to current regulation. The Client is therefore advised to contact the customs authorities in the country concerned in advance, to verify the costs and any restrictions on imports.

4.3 Time for delivery indicated by FiloBlu are merely indicative and can delay, also split deliveries shall not entitle the Client to refuse the delivery or request compensation or indemnity. 

4.4 When the delivery arrives, the Client is required to check: 

  •        that the number of packages delivered corresponds to the number shown on the delivery note.
  •        that the packaging is not damaged, wet or ruined, including the materials used for sealing (adhesive tape or metallic strapping).

Damage to the packaging and/or to the product or lack of correspondence in the number of packages, must be notified immediately by indicating the nature of the problem on the delivery note, that shall be returned to the carrier.

If problems linked to the physical integrity, correspondence or completeness of the goods received must be notified within 7 days from delivery, in accordance with the methods explained in this document.

Taiwan Customs Regulatory Changes

As of July 1st 2022, the Taiwan Customs Authorities require pre-registration and pre-clearance authentication for import shipments to consumers (2C) in Taiwan.

This is mandatory for Business-to-Consumer (B2C) & Consumer-to-Consumer (C2C) shipments to Taiwan.

All private consumers (consignees/importers) of shipments into Taiwan are required to download the EZWAY Customs application & register their mobile phone numbers.

When goods are ordered and the DHL Express Waybill to Taiwan is created, the private consumer in Taiwan will be notified by DHL (via SMS/e-mail) and by the EZWAY Customs application to pre- authenticate their shipment against their unique DHL Waybill Number (via the EZWAY application). This process must be done for each import shipment to allow the Customs Clearance of the goods, and is called Real Name Authentication (RNA).

Please be aware that without the EZWAY mobile phone registration (one-off) & pre-authentication (per shipment), your shipment will be: Rejected during Customs Declaration Held at the Taipei Gateway and contacted by DHL for RNA process.
Returned to shipper if the receiver does not pre-register and authenticate their shipments within 7 days of arrival. Subjected to Bond Storage charges (for the period that the shipment is held)

5. Right to cancel

5.1 According to the 52 Article of Italian Legislative Decree 206/2005, as amended by Italian Legislative Decree 21/2014, the Client may withdraw from the Conditions and therefore from the purchase agreement for any reason, without need for an explanation and without incurring any penalty, within 14 (fourteen) days from the date of receiving the products.  

5.2 In order to exercise the right to cancel set out in the preceding Clause 5.1, the Client has to notify to FiloBlu within the time limits completing the form on the website. It is possible to consult the page RETURNS & REFUNDS for instructions on how to send a return request authorization.

When the client in both cases will complete the return request, he will receive a confirmation email (RMA).

Within 48 hours, the Client will receive an RMA Authorization email with the address of the warehouse to return the goods.

This last mail must be printed and placed inside the parcel to be sent back.

5.3 In the event of cancellation, the Client has to return the products to FiloBlu at the Client's expense within 14 (fourteen) days of said cancellation as mentioned on the article 5.2:

The goods must be returned undamaged, complete in all their parts and in their original packaging (envelopes and packaging), kept and used only for strictly necessary to time to establish and verify their condition, features and size. The items must show no signs of use or dirt and with the following conditions must be respected:

  •       the right to return can be applied to the purchased products as a whole; it is not in fact possible to return only part of the purchased product (for eg, accessories, complementary items, etc.);
  •       in order to return, the product must be complete and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessories: labels, cards, tags, seals, etc.)
  •       transport expenses (and customs fees, if applicable) arising from the return of the goods will be at Client’s expenses
  •       the Client is to be considered responsible for the delivery until the parcel is received in the warehouse managed by FiloBlu
  •       if the goods get damaged in transit, FiloBlu will notify the Client, in order that the Client may promptly file a complaint against the courier that was used and obtain appropriate compensation; the product will be available to the Client and the request will be cancelled
  •       FiloBlu is not responsible for any damage, theft or loss that occurs during or when the parcel is returning back

5.4 FiloBlu will refund the Client for the whole amount paid for the returned product, net of any additional costs of delivery expenses and custom fees (art. 56, comma 2, del D. lgs. 21/14), within 14 (fourteen) days after FiloBlu became aware of the Customer's exercise of the right of withdrawal, after verifying the correct execution of the right of withdrawal and the returned products. The refund payment method will be the same method used by the Client for the initial transaction, unless otherwise agreed. In any case, the Client will not bear any costs as a consequence of this refund. FiloBlu may withhold the refund until the returned product is received.

5.5 In any case, the Client will not have the right to be refunded by FiloBlu if: 

  • the returned product and/or its accessories, and/or its packaging are not intact.
  • the product is without its external package and or the original internal packaging.
  • the product is missing some of its integral parts and/or accessories (for e.g., fastenings, ties, buckles, etc.).

In this case, FiloBlu will return the purchased product to the sender, debiting the shipping costs from the same and, if already refunded, the price of the product.

7. Warranties

7.1 All products sold by FiloBlu are covered by a warranty of 24 (twenty-four) months in case of lack of conformity according to Chapter III of Italian Legislative Decree 206/2005. To benefit from assistance under the warranty, the Client must keep the invoice or the payment receipt with the delivery note.

7.2 The warranty because of lack of conformity can be applied is the product has been used correctly, following the laundry instructions provided in and/or with the product.

7.3 If FiloBlu, for any reason, will not be able to provide the Client with a product under the warranty (repaired or replaced), or if the repair or replacement should be excessively expensive, FiloBlu may proceed offering an appropriate discount to the price paid, or refunding the whole amount paid and terminating the contract.

7.4 In the cases where the application of the guarantees requires the return of the product, the product must be returned by the Client in its original packaging, complete in all its parts (including packaging and any documentation and accessories).

9.1 Personal details collected when the Order is placed will be used by FiloBlu only to satisfy the requests of the Client, according to European regulation 2016/679 and the privacy statement shown on this website. Any other use of the details will take place only with the express consent of the Client.


 10. Applicable law

10.1  The contract for sale set out in these Conditions and its performance shall be governed by Italian Law. Any contrary legal norms and the United Nations Convention on Contracts for the International Sale of Goods shall not be applicable. Should a dispute arise, it shall be submitted to the jurisdiction of the Courts in the town where the Client is resident.

10.2  We would like to inform you that the European Commission provides an alternative resolution platform for out-of-court disputes, including cross-border disputes, accessible at http://ec.europa.eu/odr.


 11. Copyright

Trademarks, logos and other distinguishing signs on the site belong to their respective owners. The use of trade marks, logos and other distinguishing signs, including reproduction on other websites by unauthorized third parties, is forbidden. The contents of the Site are protected by copyright (text, images and graphics).

 12. Communications

All communications between the parties shall be made in writing and sent to the address of the other party as specified in the contract and the order. Communications sent to the other party’s email address, as specified on the Site and in the order, are also considered to be written communication.

Communications relating to the validity or existence of this agreement must be exclusively delivered by hand or sent by registered letter with acknowledgment of receipt.


The sales agreement is presented in two languages: IT / EN. In case of discrepancies in the translation, the Italian language version shall prevail.
